Factory Original Content 

Content which is professionally produced by The Naked Factory, LLC, Naked Factory Studios, Naked Factory Spotlight or any subsidiary there of where the actors and models have been appropriately compensated for their appearance in the content. The Naked Factory, LLC has the exclusive rights to the final product. Artist Releases in addition to age verification documentation. All of our Factory produced content is contractually licensed and USC 2257 compliant. The Naked Factory, LLC has an appointed Custodian of Records in the event it becomes necessary for The Naked Factory, LLC or government to request documents.

Partnered Content 

Content which is where an independent Producer enters into an agreement with The Naked Factory, LLC to share, promote and showcase their content on sites owned and operated by 

User Content 

All non-commercial content that  is uploaded and shared by users on profiles and messaging.  Due to the fact that this content is uploaded to the Site(s) by users of the sites, it falls under Section 230 of the Communications Decency Act. Section 230 protections are not limitless, requiring providers to remove material illegal on a federal level, such as in copyright infringement. 

In 2018, Section 230 was amended by the Stop Enabling Sex Traffickers Act (FOSTA-SESTA) to require the removal of material violating federal and state sex trafficking laws. 

Additional, recent regulations have been put in place by Mastercard that further regulate user-submitted adult content.

All Users of any The  Naked Factory, LLC site must agree to the Terms and Conditions of The Naked Factory, LLC and can be found here: https://nakedfactory.info/terms-and-conditions

All of the Content, photographic and audio-visual, that appears on The Naked Factory network of  websites produced by Independent Studios and users is provided “exactly as shown”.  The Naked Factory does not alter or modify content in any way, with the exception of watermarks. 

Contact the Independent Studios or Users directly regarding legal concerns or copyright issues pertaining to their content. If performers under the age of 18 are suspected to appear in any content, this must be reported immediately to us. Naked Factory, we will cooperate in any way possible with any Government or with concerned individuals, to prosecute any producer of illegal content. 

The Naked Factory, LLC will immediately remove any content that we are made aware of that violates any law. Content producers are contractually and legally obligated to provide 18 USC 2257 compliant content. 

The Naked Factory, LLC  does not allow content that violates U.S. or E.U. obscenity laws, and FOSTA-SESTA.

The Naked Factory, LLC further acknowledges that it is it’s legal obligation to comply with the labeling provisions of Section 2257, and that it must provide the information required by such labeling provisions for each depiction appearing in its content, in addition to maintaining all required age records, URLs, and other information, indexed in the required manner. Model Releases

The Naked Factory, LLC understands and agrees that signed Model Releases are required by all performers for each production, including but not limited to their stage name, real name, date(s) of production, brief description of scene and specific reference to The Naked Factory, LLC and its network of sites.Releases must provide The Naked Factory, LLC  with the irrevocable, perpetual and unrestricted right and permission to take, use, re-use, publish, and republish video and photography in which model may be included, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations, in conjunction with my own or a fictitious name, or reproductions thereof in color or otherwise, made through any medium at his/her studios or elsewhere, and in any and all media now or hereafter known, specifically including but not limited to distribution over the internet for illustration, promotion, art, editorial, advertising, trade, or any other purpose whatsoever.

Copyrights

Content shall be entirely original and not infringe upon any third-party rights, title or interest. Any independent Proudction Studio or User  indemnifies The Naked Factory, LLC from any damages suffered by it as relating to Content; The uploader  represents and warrants that it is the sole owners of Content; its intellectual property rights are not contested; Content complies with all application laws, regulations, treaties and restrictions of the United States, including USC 2257; no performers under the age of 21 appear in Content; no forced sex appears in Content; no bestiality appears in Content.

2257 Disclosure Statement

Compliant Content

All models, actors, actresses, and other persons that appear in any visual portrayal of actual or simulated sexually explicit conduct appearing on, or otherwise contained in, this Website were over the age of eighteen (18) years at the time the visual image was produced. Records required for all depictions of actual or simulated sexually explicit conduct by Title 18 U.S.C. §2257 and 28 C.F.R. §75, et seq., are on file with the appropriate Records Custodian. 

Exempt Content

All other visual depictions displayed on this Website are exempt from the provision of Section 2257 because: 

 they do not portray conduct as specifically listed in 18 U.S.C §2256 (2)(A) (i) through (iv); 

 they do not portray conduct as specifically listed in 18 U.S.C. §2257A produced after March 19, 2009; 

 they do not portray conduct listed in 18 U.S.C. §2256(2)(A)(v) produced after March 19, 2009; 

 the visual depictions were created prior to July 3, 1995; or, 

 this Company does not act as a “producer” with respect to the dissemination of such exempt images as that term is defined in 28 C.F.R. §75.1(c).

Non-Consensual Content Policy

The Non-Consensual Content Policy places a strong emphasis on the importance of consent for user security and platform integrity. Uploading individuals are required to affirm that they have obtained valid consent and proper release documentation for all individuals featured in the content. Content must align with the platform’s core values, community guidelines, and Terms of Service. Any content found to be in violation of the Non-Consensual Content Policy will be removed, and the user’s account will face appropriate action.

Violations of the non-consensual content policy include the recording or distribution of intimate images without consent, as well as content featuring or promoting non-consensual acts, whether real or simulated. The guidelines explicitly prohibit uploading explicit images or videos taken or shared without the consent of the individuals involved. This includes hidden camera content, revenge porn, and sharing non-sexually explicit images without consent.

The policy also prohibits content, including fictional or animated, that depicts non-consensual sexual activity, forced sexual acts, or individuals appearing drugged or incapacitated. The platform expects all content, regardless of whether it is professional or amateur, to adhere to its core values and Terms of Service.

Certain sensitive themes such as spells, mesmerizing, possession, sleep, bondage, and sub-dom fantasies are subject to specific considerations for consent. The platform differentiates between fantasy and reality and may remove content that violates the Terms of Service related to these themes.

To ensure compliance with the policy, the platform employs a 24/7 human moderation team to review uploaded content, address user concerns, and remove non-consensual content. Users are encouraged to report any violative content to help maintain the platform’s integrity and safety. Automated tools such as StopNCII.org and MediaWise® service are also utilized to identify and remove illegal content.

Consequences for policy violations may include the suspension or permanent termination of the uploader’s account. Users are encouraged to promptly report any non-consensual content or violations of the Terms of Service. Victims or individuals with knowledge of policy violations can submit a Content Removal Request Form for confidential review and removal of the content.

For additional support and information, users can reach out to local law enforcement, crisis lines, or organizations dedicated to assisting individuals in need. The platform remains committed to protecting user safety and relies on technology, human moderators, and community cooperation to combat the dissemination of non-consensual content.

Our Plan

To Prevent, Detect and Report Modern Slavery and Human Trafficking Risk we will be implementing the following”

Implemented a company wide mandatory modern slavery and trafficking training as part of our employees and Artist’s education with Naked Factory.

We have company-wide policies and procedures as to acceptable business practices and ethical conduct;

In the process of developing an updated approach to content moderation including utilizing Artificial Intelligence. 

Appointed a content management division to monitor, review our safety controls and compliance program and to continue to enhance the safety of our products, employees, communities; and brand.

Build relationships with third-parties like the Adult Industry Union that seek to combat modern slavery and human trafficking.

Our Policies

Naked Factory is committed to taking all reasonable and appropriate steps to ensure that there are no modern slavery or human trafficking activities taking place on our company, in our products, on our sites or in our supply chain.

 We have a Code of Conduct & Business Ethics in place which sets out our expectation that all employees act with integrity and to exercise good judgment and common sense in their efforts to comply with all applicable laws, rules, and regulations, including in relation to modern slavery and human trafficking. 

To mitigate the risk of modern slavery and human trafficking we have provided reporting channels for suspected instances of modern slavery or human trafficking.

 Our Terms of Service and Acceptable Use Policy specifically prohibit the uploading, posting, displaying, or publishing of content on Naked Factory that:

 shows, includes or refers to any other individual unless written consent is obtained from each individual to use their name or images (or both) in the Content; or

 shows, promotes, advertises or refers to escort services, sex trafficking, or prostitution.

Perform Risk Assessment continually assessing modern slavery and human trafficking risks in our business environment through identifying and analyzing higher-risk areas of our business. 

Business Operations

We consider the risks of modern slavery and human trafficking to be relatively low in our direct business operations as our direct workforce is largely comprised of professionally qualified or skilled personnel. We ensure that our entire workforce is aware of these risks and our views toward these issues, and that they can report any instances of suspected modern slavery or human trafficking.

Products and Supply Chain

As with all social media platforms, there are risks related to Users’ Uploads, including the risk of material being uploaded that is exploitative and in breach of various laws and our policies.
We use staff for our network of sites and A.I. enhanced bots to assist with, user verification and content moderation processes..

Merchandise

We procure merchandise, which is provided to site members, Artists, and Production Team for marketing purposes and is available for sale on the Naked Factory shop. These items may be manufactured by a workforce that is at more risk of exploitation. We understand the garment manufacturing industry has the potential for modern slavery and human trafficking, including in such areas as freely chosen employment, young workers, working hours, wages and benefits, humane treatment, non-discrimination/non-harassment, and freedom of association.

Our Efforts

We have continued to work to mitigate risks and we are committed to report on key points of action that we intend to take going forward.

Verification for all users

We carefully check all identity and payment details for each Artist’s account application to ensure that individuals can only make an account on their own behalf. We specifically check for any discrepancies between identity documents and the legal name provided on payment methods, and employ technological safeguards to prevent creator payment details from being changed by the user. This is to ensure the Artist is receiving payments directly from Naked Factory.

We require an additional “selfie” identification In certain high-risk jurisdictions or where additional security after our initial verification process has been completed.

Content Moderation

In order to prevent and detect harm, we monitor all media uploaded to the platform and remove, and report where necessary, any content that facilitates or coordinates the exploitation of people, including modern slavery and human trafficking. All our content moderators are trained to identify and swiftly report any suspected modern slavery including trafficking. 

We have also implemented company wide training on modern slavery and human trafficking for all employees. The training is required annually and provided via an online training provider.
Merchandise. When entering into commercial agreements with manufacturers we consider the relevant provisions of our Code of Conduct & Business Ethics, Terms of Service, Acceptable Use Policy and this Anti-Slavery & Anti-Trafficking Statement to ensure these agreements align with our policies against modern slavery and human trafficking.

Community Reporting

We continued to expand our support functions to deal with any concerns or complaints from our users and from the wider community. Each post and account on Naked Factory has a report button. Any reports escalated from our platform are reviewed internally by our moderators. In addition, we encourage anyone encountering content on Naked Factory that indicates someone is in immediate physical danger relating to human trafficking to immediately report the content to us at compliance@Naked Factory.app.

Assist Law Enforcement

If Naked Factory identifies content which contains indicators of modern slavery or human trafficking, we immediately suspend the associated account and pass this information to law enforcement and non-governmental organizations to help identify the perpetrators.

Investments and Partnerships

We also continue to invest in our ability to detect content related to human exploitation through major investments by our technical and operational teams. We are increasing our investments and ability to identify the illicit actors, networks, organizations, and businesses that perpetrate these activities and disrupt them accordingly. We look to enact counter measures – both on our platforms and via our external partnerships to stop actors and businesses from using our services to commit crimes, and in all stages of the exploitation lifecycle. We work with a range NGOs, helplines and charities in order to support our strict policies on safeguarding our users and workforce, including working with, and participating in the reporting systems of, the National Center for Missing & Exploited Children (NCMEC) and other well-known NGOs.
